Blue Collar Leads, LLC

1. Subscription Services

Blue Collar Leads offers managed lead generation and appointment-setting services on a recurring subscription basis for blue-collar contractors and small business owners in HVAC, roofing, plumbing, electrical, restoration, and related trades.

When enrolling, you pay for: access to managed services, dedicated labor and operational capacity, marketing expertise and campaign management, and use of systems to generate and deliver leads or appointments.

Subscription fees are charged for access to services, labor, and operational capacity—NOT for a guaranteed number of leads, appointments, conversions, or revenue outcomes.

2. No Guarantee of Results

Blue Collar Leads makes no guarantees regarding lead quantity, quality, appointments, conversions, closed jobs, or revenue. Specifically excluded: minimum/maximum leads per billing period, booked appointments guarantees, specific conversion rates, or that leads result in paying customers.

Results vary based on market conditions, seasonal demand, your pricing and reputation, responsiveness to leads, calendar availability, local competition, and scope of services offered.

3. Billing Authorization & Renewal

By providing payment information, you authorize Blue Collar Leads to charge your payment method for subscription fees on a recurring basis (weekly, monthly, or as specified), store payment information for automatic “off-session payments,” and charge onboarding or setup fees.

Charges apply regardless of service volume. Your subscription fee is due each billing period whether or not you receive leads, appointments, or other deliverables.

Subscriptions renew automatically until canceled. Cancellation is your responsibility before the next billing cycle.

4. No Refunds / Final Charges

All subscription fees, onboarding fees, and charges are final and non-refundable once a billing period begins.

Refunds cannot be issued for: fewer leads/appointments than expected, non-converting leads, market conditions, seasonality, or dissatisfaction with outcomes.

5. Cancellation Policy

Cancel anytime via email or SMS. Upon cancellation:

  • Your subscription remains active through the current paid period
  • You continue receiving services through period end
  • No further charges process after the period ends
  • No refunds or prorated credits are issued
Cancellation prevents future billing only. All charges incurred prior to and including the current billing period remain due and payable.

6. Calendar Access & Client Responsibility

You must:

  • Provide and maintain accurate calendar availability
  • Keep calendar current
  • Respond promptly to booked appointments
  • Show up or provide notice for rescheduling

Blue Collar Leads is not responsible for:

  • Missed appointments due to calendar conflicts
  • Appointments that cannot be scheduled due to inadequate availability
  • Lost revenue from your failure to maintain calendar access
  • Prospect no-shows

7. Service Types & Distinctions

Three service models exist:

  • Subscription Services: Fixed recurring managed lead generation and/or appointment-setting (Sections 1–6)
  • Pay-Per-Lead Services: Variable charges for individual qualified leads (Section 8)
  • One-Time Services: Project-based marketing services as disclosed at enrollment

Sections 9–16 apply to all service types. Multiple enrollments trigger all applicable terms.

8. Pay-Per-Lead Services

8.1 Pay-Per-Lead Billing Authorization

Authorization includes:

  • Securely storing your payment method and charging for qualified leads
  • Processing variable recurring charges based on leads delivered at the per-lead rate shown at checkout
  • Automatically charging without requiring presence (“off-session payments”)
  • Charging applicable onboarding/setup fees

You authorize charges for each qualified lead without further approval.

8.2 Pay-Per-Lead Pricing

The per-lead rate is as displayed at checkout or agreed in writing.

Blue Collar Leads reserves the right to adjust pricing with reasonable notice. Continued use of Services after a pricing change constitutes acceptance of the new rate.

8.3 Pay-Per-Lead Delivery

Leads are delivered immediately or as soon as practicable after generation. If payment processing fails, lead delivery may pause until a valid payment method successfully charges.

8.4 Pay-Per-Lead No Refunds

All pay-per-lead charges are final and non-refundable once a lead has been delivered.

This includes leads not resulting in closed jobs, unresponsive prospects, and leads not meeting your expectations.

Disputed leads (spam, duplicates, outside service areas) may result in account credit at company discretion—not refunds.

8.5 Pay-Per-Lead Cancellation

Cancel anytime via email or SMS. Upon cancellation:

  • No further leads deliver
  • Charges for prior delivered leads remain due
  • Outstanding balances must be paid in full
  • Onboarding fees are non-refundable

8.6 No Volume Guarantees

Blue Collar Leads makes no guarantees regarding the number of leads you will receive through pay-per-lead services. Lead volume may vary based on market conditions, seasonal demand, your service area, and other factors outside our control.

9. Lead & Appointment Definitions

For Services purposes:

  • Lead: Completed inbound form submission with valid contact details, inbound phone call exceeding 15 seconds, or any inbound inquiry expressing service interest through marketing channels.
  • Appointment: Scheduled meeting or call between you and prospect booked through appointment-setting services.
  • Qualified Lead: Lead meeting above criteria and not spam, duplicate, or invalid per Section 10.

Leads/appointments from spam bots, competitors, existing customers, or duplicates may be excluded or evaluated for credit at company discretion.

10. Quality & Disputes

Notify Blue Collar Leads within 24 hours if you believe a lead/appointment is invalid (spam, duplicate, outside service area).

Determinations of validity are made at the sole discretion of Blue Collar Leads.

After 24 hours without dispute, leads/appointments are automatically deemed valid and billable.

For subscription services: quality disputes don’t affect subscription fee obligations. For pay-per-lead services: approved disputes may result in account credit—not refunds.

11. Chargebacks & Disputed Payments

Don’t file chargebacks, payment disputes, or reversals for validly authorized charges including subscription fees, per-lead fees, and onboarding fees.

Filing a chargeback/dispute may result in:

  • Immediate service suspension
  • Account termination
  • Collection efforts including agency assignment
  • Recovery of chargeback, legal, and collection costs

Contact support directly before initiating chargebacks with financial institutions.

12. Payment Method Responsibility

Ensure your stored payment method remains active, valid, and sufficiently funded for all charges. If declined/failed: services may pause or suspend, lead delivery may pause, charges may be reattempted, and you remain responsible for all fees including leads delivered before payment failure.

Promptly update payment information if your method changes, expires, or cannot process charges.

13. Limitation of Liability

To maximum extent permitted by law, Blue Collar Leads isn’t liable for indirect, incidental, special, consequential, or punitive damages including lost profits, revenue, business opportunities, goodwill, reputation loss, substitute service costs, or damages from service use or inability.

Our total liability for any claims arising from or related to these Terms or our Services shall not exceed the total fees paid by you to Blue Collar Leads during the three (3) months immediately preceding the claim.

14. Governing Law & Disputes

Terms are governed by Delaware law without regard to conflict of law provisions. Disputes are resolved through binding arbitration per American Arbitration Association rules. You waive jury trial and class action rights.

15. Modifications to Terms

Blue Collar Leads reserves the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

16. Entire Agreement

These Terms, plus service-specific enrollment terms, constitute the entire agreement. They supersede prior agreements, representations, or understandings.

By submitting payment information or enrolling in a subscription, you acknowledge that you have read, understand, and agree to be bound by these Terms of Service. Your enrollment constitutes your electronic signature and full acceptance of these Terms.
